Builder’s Remedy AB 1893 and AB 1886 is the consequence of local governments failure to adopt legally sufficient housing plans. When the local government has failed to plan for the number of homes required by the state, the city has to approve any project that restricts at least 20% of a project to low-income households or 100% of a project to moderate income households. Berkeley is not in the list.
